By January 13, 2018, each European Union member state must implement the so-called PSD2 (Payment Service Directive 2) into their national legislation, EU Directive 2015/2366, which entered into force in 2016. The implementation of this directive marks significant steps forward in the world of e-commerce and digital payments, reshaping the landscape of online commercial transactions and aiming for greater consumer protection. Specifically, the new rules:
- they prohibit surcharges, that is, the application of a surcharge on payments by credit or debit card, both in stores and online;
- open up the EU payments market to businesses providing payment services by giving them access to payment account information;
- establish stringent security requirements for electronic payments and for the protection of consumer financial data;
- They strengthen consumer rights in several respects, for example by reducing their liability in the event of unauthorised payments and by introducing an unconditional right to a refund (without the need for explanations) for direct debits in euros.
